Terms and Conditions

We the People throughout the world, have been given certain inalienable rights (rights granted by God) that cannot be taken away by governments. The Declaration of Independence spells out at least three of these: life, liberty and the pursuit of happiness.  The ability to commerce is related to all three of these because if a government has the power to take away our ability to buy and sell – this will directly affect our life, our liberty and the pursuit of our happiness. There are only certain cases in which Friends of the Original Constitution, the Constitutional Government, can curtail someone’s ability to buy and sell: these would for reasons spelled out in the Constitution as well as by the interim Constitutional Government and by a future Constitutional Council of Citizens as spelled out in Scott David Workman’s book Map of Thieves.

To obtain an Individual and Business account with FOTOC Bank (“we”, “us”, “our”), you (“you”, “you’ve, “your”) must agree (during application) to abide by these Terms and Conditions of FOTOC Bank and The Declaration of Restoration.  You must also agree to receive communications from us (to the phone number-sms-notifications-email-etc. the “means” you’ve provided) and that the only way to opt-out of communications, is to close your account with FOTOC Bank.

The currency of Friends of the Original Constitution’s Bank (FOTOC Bank) are CC’s (Constitutional Coins) with this symbol . This is the only currency and method of commerce within FOTOC Bank and cannot be exchanged for any other currency. You can have your outside currency matched and credited into FOTOC Bank but only by the three methods spelled out below and only for a limited time as specified.

How do I get the money I have now into FOTOC Bank?

Individuals and businesses who upload documents (bank/account statement(s)) will receive matching funds into their account at FOTOC Bank. This is a onetime matching of funds: Value = $ (Dollar) for  (CC’s). For matching of funds in other currency systems: the current exchange rate to convert the currencies of countries not on the $ (Dollar).

At some point (your choice) after signing up for/obtaining a verified account with FOTOC Bank, our system will scan (OCR) the documents that you upload to FOTOC Bank. Provide us with one monthly statement (only one monthly statement for each account will be accepted) dated any time after January 1^st 2019 (Pick your highest balance monthly statement for maximum benefit) and we will match that dollar amount with an equal amount of   (CC’s). We will match checking accounts, savings accounts, retirement accounts, investment accounts (stocks, bonds, mutual funds, Insurance policies with a statement of cash value, CDs, options, futures, and ETFs) and crypto currency accounts.

In addition (For Businesses only): (You must first have an Individual Verified Account to open/obtain a Verified Business Account) At some point (your choice) after signing up for/obtaining a Verified Business Account with FOTOC Bank, our system will scan (OCR) the document that you upload to FOTOC Bank. Provide us with one year-end financial statement (only one year-end financial statement for each Business will be accepted) for any year 2019 or after (Pick your highest net sales year-end statement for maximum benefit) and your Business account will receive 10% of that year’s net annual sales – credited to your account at FOTOC Bank.

(Cash conversion) For a Limited time only:

You can convert your cash (U.S. Dollars only) into a U.S. Money Order or U.S. Cashier’s Check (personal/business checks not accepted), or a debit card, credit card, Visa/MasterCard gift card and donate your FEDERAL RESERVE money through our main website donation portal here: https://friendsoftheoriginalconstitution.org/donate/ – we will not only match your funds, but you will receive 100 times (in  cc’s) the amount of your donation – Which will be credited into your account with FOTOC Bank. For example: If you donate $3,500 through this portal: https://friendsoftheoriginalconstitution.org/donate/  – you will instantly receive  350,000 (cc’s) credited into your account at FOTOC Bank.

All rules that govern the fair use of FOTOC Bank are based upon the Constitutional laws of the land. Any rules established prior to the Constitutional Convention and Court, are by Friends of the Original Constitution, the Constitutional Government; authorized by We the People’s signatures on the Declaration of Restoration and thereafter will be governed additionally by the people who serve on the Constitutional Council of Citizens as spelled out in Scott David Workman’s book Map of Thieves.

FOTOC Bank is governed by the Constitutional Government – which is Friends of the Original Constitution. All Commerce that is transacted within FOTOC Bank will be governed exclusively by Friends of the Original Constitution. No other entity, nation, corporation, contract et al., has any jurisdiction over FOTOC BANK. Anyone that commerce’s in a fraudulent way, who states to be of FOTOC Bank, but are not actually from or authorized by FOTOC Bank, will not be recognized or accepted.  Any authorized user of FOTOC Bank may commerce with any other authorized user of FOTOC Bank freely as long as they have a positive balance of CC’s and abide by the rules set forth by FOTOC Bank.

FriendsoftheOriginalConstitution.org, FOTOCBank.org, the FOTOC Bank app on any platform or operating system, are collectively the “FOTOC Bank” properties and each individually is a “FOTOC Bank Property.” By using any FOTOC Bank Property and its related services, products, and software to (i) purchase services, products, and software, or (ii) apply for available financing options to be used in commerce; services, product and software, you agree to be bound by these terms and conditions (“Terms”). You also accept the Terms when you create an account, commerce as a guest, or log in to any FOTOC Bank Property. To the extent that the provisions of any additional terms conflict with these Terms, the provisions of the additional terms will govern. We may make changes to any FOTOC Bank Property and its Terms. It is your responsibility to review these Terms and Conditions. If you do not agree with the Terms, do not use FOTOC Bank Properties. By acquiring an account with FOTOC Bank, you are bound by these Terms and Condition and agree to the future binding decisions from Friends of the Original Constitution and future Constitutional Council of Citizens; including any interpretations of any infractions or violations of its rules and these Terms and Conditions: and will determine the fair consideration of the penalty for such violations.  Please carefully review the Dispute Resolution section below.

Privacy

Your use of FOTOC Bank Properties is subject to our Privacy Policy. Please review our Privacy Policy for more on how we collect and use information.

Information on Our Site

We strive to be as accurate as possible with the information we present on FOTOC Bank Properties. We will make reasonable efforts to accurately display the attributes of this commerce platform we provide. We do not warrant that all descriptions or other content is accurate, complete, or error free. Commerce procedures are subject to change, and may vary from day to day. Any contrived products, services, exchanges, modalities, derivatives et al. (“schemes”); outside of FOTOC Bank are not our responsibility, nor will we confirm the use of any such schemes outside of FOTOC Bank . Those discovered trying to defraud our users, are subject to having their ability to commerce cancelled. Depending upon the situation, we may first pause their ability to commerce and attempt to contact violator for a resolution before further action is taken. For violators who have evidence presented of serious crimes against FOTOC Bank and or its users, we will initiate prosecution and hold a trial at a Constitutional Court/Council of Citizens to determine through the judicial process if there is a provable crime or the extent of the crime and the penalty(s) to be imposed against violator(s); or whether to be absolved and reinstated.  

Commerce Confirmations

Our confirmation of your transactions (“commerce“) does not signify our acceptance of your commerce, nor does it constitute a final confirmation of the responsibility to fund the commerce. At any time after receipt of your commerce, we may accept, decline, or place limits on your transaction for any reason as set forth by the decision of Friends of the Original Constitution and future Constitutional Councils of Citizens and will be binding upon you. We may impose these limits on a per-person, per-household, per-business, per-transaction, or any other basis. If we reject, limit, or otherwise modify your commerce, we will attempt to notify you using the means you have supplied to us. If we cancel a commerce or part of a commerce that has been settled, we’ll refund you the full amount of the canceled portion of the commerce.

Proprietary Rights

All content included on FOTOC Bank Properties, including but limited to information, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, logos, symbols and other materials, et al., (or “Content”) is protected by Constitutional proprietary rights, and these rights are valid and protected in all forms, media and technologies existing now or developed in the future. All Content is protected as a collective work under the Constitutional laws of the land, the Constitutional Government and council of Citizens rules. FOTOC Bank owns the full rights to Content, to the fullest extent allowed by Constitutional laws.  You may not remove or modify or use any identifiers or other proprietary notices, contained in any Content. You may not modify or alter the Content, copy or post the Content on any network computer, or broadcast the Content in any media. You may not copy, scrape, frame, modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale, lease or rental of, create derivative works from or in any way exploit any of the Content, in whole or in part. The FOTOC Bank Properties are the property of We the People and are licensed to, or, where required, used with permission of FOTOC Bank and may not be reproduced, copied, or manipulated in any manner without the express, written approval of Friends of the Original Constitution and future Constitutional Councils of Citizens.

User Generated Content

You may contact FOTOC Bank Properties initially through Friends of the Original Constitution’s website.   This will expand in the future to Social Media sites, SMS and other ways – including but not limited to Reviews and Ratings, videos, Questions and Answers, Community Forums, testimonials, etc.  You grant us the right to use the name and social media handle (and other means you’ve provided) that you use when you share content with us in connection with that content. When you share content with us, you will disclose your true and rightful intentions. You will not share anything that contains harmful computer code, references to other websites, or anything false, misleading, illegal, unlawful, defamatory, libelous, hateful, racist, biased, threatening, harassing, or any explicit content.

Disclaimers and Limitation of Liability

FOTOC Bank Properties provides all information, content, and other materials made available through the FOTOC Properties on an “AS IS” and “AS AVAILABLE” basis.  We make no representation or warranty that any FOTOC Bank Property will meet your requirements, or not have service interruptions; be 100% secure or be error free. It is expressly agreed that FOTOC Properties has a limitation of liability for any shortages in the above stated categories, and we are obligated only to do all in our power to restore and rectify deficiencies as much as possible. We have no further liability beyond this and no claims for damages will be honored or rewarded. FOTOC is not and cannot be held liable for any external actions by anyone, by any organization, by any other government or entity against users of FOTOC Bank for any reason. All laws or rules governing FOTOC Bank and its users are and will be set forth by the Constitutional Laws of the Land and are under the jurisdiction of the original Constitution, the Constitutional Government (Friends of the Original Constitution) and the future Constitutional Councils of Citizens.

A link to a Third-Party Site on a FOTOC Bank Property does not constitute sponsorship, endorsement, approval or responsibility for any Third-Party Site. The conditions of use and privacy policy of any Third-Party Site may differ substantially from these Terms. Export

Certain software or other materials (“Software”) that you obtain through the FOTOC Bank Properties may be further subject to export controls. You bear all responsibility and the consequences of any jurisdictions that do not recognize the authority and jurisdiction of Friends of the Original Constitution; the Constitutional Government. It is your responsibility to comply with any or all applicable export and re-export restrictions, Constitutional laws, other jurisdictions and you will not transfer, or encourage, assist, or authorize the transfer of any Software to a prohibited country or otherwise be in violation of any restriction or Constitutional law.

Security

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to not share your account credentials with others. You may not use the FOTOC Bank Properties except for lawful Constitutional purposes. Activities including, but not limited to, tampering with any FOTOC Bank Property, misrepresenting the identity of a user, and using buying agents or conducting fraudulent activities on the FOTOC Bank Properties, are prohibited. You may not violate or attempt to violate the security of the FOTOC Bank Properties, including but not limited to: (a) accessing data not intended for you or logging on to a server or an account which you are not authorized to access; (b) using any FOTOC Bank Property for unauthorized purposes or trying to change the behavior of any FOTOC Bank Property (c) attempting to probe, change or test the vulnerability of a system or network or breach security or authentication measures without proper authorization; (d) attempting to interfere with service to any user, host or network, including but not limited to means of submitting a virus to any FOTOC Bank Property, overloading, “flooding,” “spamming,” “mailbombing” or “crashing”; (e) forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting; or (f) forging communications on behalf of FOTOC Bank (impersonating FOTOC BANK) or to any FOTOC Bank Property (impersonating a legitimate user). You may not send unsolicited or unauthorized email on behalf of FOTOC Bank, including promotions and/or advertising of products or services. We may prosecute you to the full extent of Constitutional laws for any violation of these Terms. You may not use any device, software or routine or data to interfere or attempt to interfere with the proper working of any FOTOC Bank Property. You may not use or attempt to use any engine, software, tool, agent, data or other device or mechanism (including but not limited to browsers, spiders, robots, avatars or intelligent agents) to navigate or search any FOTOC Bank Property other than the app, search engine and search agents we provide and generally publicly available browsers.

Dispute Resolution

Any dispute involving you and FOTOC Bank or any of its agents must be resolved though Friends of the Original Constitution and future Constitutional Councils of Citizens. Before either Party may initiate a proceeding, you agree to engage in a good faith effort to resolve the Dispute informally with Friends of the Original Constitution’s agents.  A Notice must include your name and contact information (address, telephone number, and email address) and information sufficient to enable FOTOC Bank to identify any transaction(s) at issue.  The Notice must also include a detailed description of (1) your Dispute; (2) the specific facts supporting your claim(s); (3) the nature and basis of the damages you claim to have suffered; and (4) a calculation and explanation of the relief sought.  Your Notice must be sent from your contact information on record (email) by way of our contact page on our Friends of the Original Constitution website.  

Termination of Use

We may, at our sole discretion, terminate your account or limit or suspend your use of the FOTOC Bank Properties at any time due to any infractions or violations identified and confirmed by Friends of the Original Constitution and future Constitutional Councils of Citizens. You are personally liable for any commerce that you engage in or charges that you incur prior to termination. We may change, suspend or discontinue all or any aspects of any FOTOC Bank Property at any time without prior notice.

Use of the FOTOC Bank Properties

You may use the FOTOC Bank Properties for your personal use (individual accounts) and business use (business accounts) only. You may not use any FOTOC Bank Property if you are under the age of 18 at this time. [The following feature will be made available in the Future. It is not available now: Savings Accounts for minors: (under age of 16) and must have a parent or guardian as joint owner on the account.  Transaction accounts (ages 16 and 17) must have a parent or guardian as joint owner on the account. The 10,000 CC’s will become available to use only after the individual becomes 18 years old]

Terms and Definitions

Fair use:  CC’s are approved for all lawful Constitutional commerce. Friends of the Original Constitution and future Constitutional Councils of Citizens govern all commerce and no one is allowed to hinder commerce, trade or barter or charge a percentage above the amounts established on the FOTOC Bank application, (for example: an external individual, business or government imposing a tax or fee to use CC’s/FOTOC Bank) without agreement from the people – represented in Constitutional Councils.  CCs may only be used for commerce by living biological individuals (and those of age), and businesses in good standing with the community.

Fair use: Allows people and businesses, without FOTOC Bank’s permission, to use our content only for lawful Constitutional purposes such as criticism, comment, news reporting, teaching, scholarship, or research. We believe and sustain the First Amendment and everyone’s guaranteed rights such as peaceful assembly, freedom of speech, and freedom of religion.

Citizens:  A Citizen is anyone who comes under the jurisdiction of Friends of the Original Constitution, the Constitutional Government for the United States of America. All those throughout the world, who sign the Declaration of Restoration are welcome to use FOTOC Bank for their lawful Constitutional commerce. In the future, all those who follow God and His authorized Government, Friends of the Original Constitution, will become beneficiaries of the Benefits and Retirement programs authorized by We the People’s signature on the Declaration of Restoration, to be ratified by the Constitutional Council of Citizens hereafter.  No artificial intelligence, inanimate objects or animals will be considered as a Citizen. 

Institutions:  Friends of the Original Constitution’s Bank (FOTOC Bank), in the future, will be funding Institutions listed, but not limited to those listed in this section: 1. the liberty loving people within other countries to form their own Constitutional Government. 2. We will not be funding any dictators or dictatorships of any country. 3. We will also NOT be funding any State governments that continue to kowtow and support the criminal so-called FEDERAL GOVERNMENT! We will be funding States – in the true USA – to reform their State Governments – back to Constitutional States which operate only under the Constitutional Government and Constitutional laws. 4. The judicial system. 5. State Governments. 6. Schools. 7. The police. 8. The military. 9. Banks: will soon be allowed to operate under FOTOC Bank and be able to access wholesale funds – to offer loans and mortgages (and other services) at more reasonable rates than they are now – due to the manipulations of the FEDERAL RESERVE.

FOTOC Bank will fund institutions found in good standing with the Citizenry. All Institutions funded, must abide by the Constitutional Laws of the Land and agree to be under the jurisdiction of the original Constitution, the Constitutional Government (Friends of the Original Constitution) and the future Constitutional Councils of Citizens.

Commerce/Forfeiture/Suspension:  All commerce engaged in, must be done in a manner of good faith, good conduct, fairness and in harmony with the Constitutional laws of the land. Commerce is available to all Citizens, businesses and Institutions which are in good standing.  Cancelling or restrictions of commerce for nefarious purposes, political gain or other unconstitutional reasons are unlawful. All reasons for forfeiture, suspension, restricting or imposing limitations on commerce to anyone using FOTOC Bank must be Constitutionally justified by Friends of the Original Constitution; the Constitutional Government, by a future Constitutional Council of Citizens or by the reasons set forth in the Commerce Confirmations and Information on Our Site – sections above.

Any policies, statutes, laws, procedures, protocols, mandates, orders (“Activities”) that are “legal” in the so-called “FEDERAL GOVT” (or any government on earth) which are unconstitutional, including but not limited to lobbying (bribery/influence buying and selling), monopolies, etc., by Institutions or individuals etc., will not be allowed to commerce. Those Individuals, businesses or groups listed on our Complaint/Lawsuit will not being allowed to commerce on FOTOC Bank; until such time as the Constitutional Convention & Court is convened or a Councils of Citizens rules in favor of said Defendants. Any Activities found to be unconstitutional by the Constitutional Government (Friends of the Original Constitution) and the future Constitutional Councils of Citizens will be subject to the prosecution, decisions, judgments, and penalties of said Councils.

Good Standing:  All are considered in good standing except those restricted or removed by the Constitutional Government (Friends of the Original Constitution) and the future Constitutional Councils of Citizens. Individuals removed from society (prison) will have their account managed by designated Councils (not by friends or family of prisoner).  

Miscellaneous: Do not try to game the system. Fraud will be detected. This is We the People’s system and Friends of the Original Constitution, the Constitutional Government will hold you accountable. See Termination of Use section for more information. Any fraud or other serious violations detected will be prosecuted by the Constitutional Government (Friends of the Original Constitution) and future Constitutional Councils of Citizens and the individual who is caught and proven to have committed fraud, will be subject to the prosecution, decisions, judgments, and penalties of said Councils.

Upon opening an account, all Individuals to receive a unique 8 or 9 digit ID number that cannot be reused or misused. A unique number to be assigned to each individual and cannot be re-assigned.  The unique 8 or 9 digit ID number is retired upon the death of an individual. (Coming soon: This number can be tagged to one surviving spouse (to receive their benefits until the surviving spouse’s death).

Two types of accounts available for customers; a savings account and a transaction account.

The following 6 rules (proposed Amendment to the Constitution) are set forth to – forever – put an end to MONOPOLIES:

1. 1. No individual can have in excess of 100 Billion (cc’s) in their account.
2. 2. No business can have in excess of 300 Billion (cc’s) in their account.
3. 3. No individual or groups of individuals can have control or ownership of one or more businesses that exceeds 300 Billion (cc’s) in their account(s).
4. 4. To open or maintain an account in which ownership of said account approaches or exceeds the  300 Billion (cc’s) amount rule above, said company must be either broken up, divested or the ownership of their respective company must be split equally between the employees of said company for account to be opened or account to remain open.
5. 5. MONOPOLIES are why we are in this world-wide tyrannical mess. MONOPOLIES will NEVER AGAIN be ALLOWED – EVER – in the Constitutional United States of America. The first great MONOPOLY is that “CORPORATION that is masquerading as our government.” THE FEDERAL RESERVE BANK is the second greatest MONOPOLY of our modern era. It is the great counterfeit monetary system of the world, that’s kept us in bondage to it – for over 100 years. 6. 6. MONOPOLIES have brought this country to the brink of destruction. One of the main reasons Friends of the Original Constitution began – was to initiate a Complaint/Lawsuit against the so-called “FEDERAL GOVT” and over 140 MONOPOLISTS for $500 Trillion. We are going to prosecute these Defendants with Constitutional Councils of Citizens and at the Constitutional Convention & Court. We the People are unitedly going to finalize the righting of the wrongs perpetrated against us; by this counterfeit government and their counterfeit monetary system and their co-conspirators (the Defendants). As much as in We the People’s earthly power, and by what God’s grants us, we will restore what the Defendants have stolen from us; our money, our health, our liberty, our freedom, our Constitution and our Constitutional Government.

Everyone who uses FOTOC Bank is bound by the Constitution for the United States; by the voice of the people in future Constitutional Councils of Citizens and by the Constitutional Government (Friends of the Original Constitution). No so-called “social constructs” – from the “Corporation masquerading as our government” and the Defendants in our Lawsuit – will have any influence or bearing on your ability to buy and sell with FOTOC Bank.  Examples of “social constructs:” Social Standing; Social Credit Score; Social Status system; vaccine passports, carbon footprint (ESG’s), etc. Other examples such as ideology, race, religion, gender, political party have no bearing on your ability to buy and sell with FOTOC Bank.

Any unconstitutional activities, including but not limited to anyone or any group – such as special interest groups or lobbyists – which attempt to or actually engage in the buying and selling of influence (any form of bribery; lobbying, etc.) of anyone within the Constitutional Government (Friends of the Original Constitution) using FOTOC Bank; will be prosecuted and will be held accountable by the Constitutional Government (Friends of the Original Constitution) and future Constitutional Councils of Citizens. All such individuals or groups caught and proven to have committed such unconstitutional activities, will be subject to the prosecution, decisions, judgments, and penalties of said Councils.

Limitations on non-fraudulent transactions (accidental transactions such as funds transferred to the wrong account, etc.): If you believe a transaction went to the wrong individual or business or it was accidental or suspicious, contact us within 48 hours and provide full details of the transaction; date, time, amount and an explanation of the circumstances, etc. We will investigate and get back to you with a determination for a reversal or a restoration, or a denial (if warranted).

The preceding as well as the following future services or Terms and Conditions will be decided upon and are governed by the Constitutional Government (Friends of the Original Constitution), the Founding Council or future Constitutional Councils of Citizens:

1. 1. Timeframe of inactive accounts. 
2. 2. Timeframe of hung transactions.
3. 3. Retroactive benefits. Surviving spousal
4. 4. Joint owner on savings accounts and transaction accounts.
5. 5. Savings Accounts for minors.
6. 6. Transaction accounts for minors.
7. 7. All Savings Accounts – receive 3% annual interest (based on daily average in account paid monthly). In the future, if you open up an account with a bank that joins our system, you’ll get an additional 3% annual interest).
8. 8. Ownership of this Bank is equally divided between each and every person throughout the world and all will receive benefits and retirement (general list found here).
9. 9. A potential physical  (cc) currency: or a solution to be able to do offline transactions.  
10. 10. Things not considered yet or not addressed in these Terms and Conditions.

These Terms and Conditions will be modified and updated without notification. Check back on a regular basis for the latest and revised version.
